Not sure if this picture shows it well or not.
Basically, the body and tailgate are flush at the bottom but there is a gap at the top. (it is not a gap left and right, its a gap front and back if that makes sense.)
Is it a hinge problem? or, that round metal piece that the tailgate locks into? or is the whole gate warped?
Any insight into this would be amazing. Thanks

This issue is somewhat common. The glass can "jump" over the tailgate when you hit a bump. There are a couple ways to adjust the tailgate, either at the hinges or at the striker (the large pin that sits inside the tub that the tailgate latches onto).

I couldn't get any adjustments to make a difference, so my solution was to put a strip of bulb trim seal on the top lip of the tailgate: https://www.amazon.com/dp/B01HVDO86K/?tag=wranglerorg-20

Another option is this type of seal: https://www.amazon.com/gp/product/B07DGFMZJF/?tag=wranglerorg-20

Not my image, but this is what the bulb trim seal looks like.

Would this be the same for a soft top? I don't have any glass on mine.
Here is an image with arrows of my problem. should have drew the arrows on the first one.

My Jeep has this as well although not quite as bad. It developed from over 20 years of having a tire hanging on it and warping the tailgate. I recently installed a Morryde reinforcement to help but the bit of gap is still there.

Same here. It’s a slight warp.
