Looks cracked to me. I would wire brush it all down for a closer inspection. May not break on your fire road, but if it does it will make for a crappy day......
^ clean up and see if that mashed metal that looks like a crack in picture one goes further in toward the bolt. If not you should be GTG.

If the question is about the metal that has been ground away by misc rocks or whatever, no problem.
If the question is about what looks like at least two weld repairs to the bracket, that whole thing needs cleaned or wire brushed so we can take a better look.
