Is my timing off?

What brand CPS? TJs can be picky about that and Mopar is generally the recommended brand. Make certain that the sensor's wiring is intact and well grounded.

Can you describe how it runs? Any driveability complaints? Has it thrown codes since the engine was installed?

Since it's a new engine, it's not likely that the chain is bad, but you could ask the engine rebuilder about it to make sure. The FSM has a procedure to check for stretch.
It runs smoothly idles great until I turn on the heat or ac then it bounces like it was cammed every now and then kind of hiccups at highway speeds

I pulled the distributor today and the teeth on it had flat spots wore into them the previous owner had the engine replacement done at shop then immediately sold it wonder if they didn't mess up the install somehow

That is just bizarre.

A new distributor is in order. I replaced mine about a year ago, and the new ones come complete with new cam position sensor. Get the best one you can get, and if I can replace mine on my own, certainly you can do it-it's a fairly simple job.

Yeah I got one installed over my lunch break it still idles weird and jumps but the codes haven't come back.....yet
 
Ok, good. One thing down, at least. Did you disconnect the power and reset the PCM? I don't know if that would help or not, but that is the next step I would do.
 
With the battery disconnected, you disconnect the positive and negative leads from the PCM that are connected to the PDU and touch them to each other for about 30 seconds to discharge all of the memory and capacitors. Then reconnect the PCM to the PDU and reconnect the battery.

Yes I did it looked good it wasn't worn like the distributor gear which makes me think it was swapped over from the original engine that and it was a mopar unit which isn't made anymore
