On a Lighter Note

I used to know a man here in NC who once got a DUI charge on horseback. I always thought that was a bit absurd.

On a side note, I've had to walk through ALE checkpoints back in college. Also ridiculous.

I’ve lived in areas where the law was written as “any means of transportation” so riding a skateboard or paddling a kayak could get you a DUI. I never understood how that applied to something that did not require a drivers license to operate.

Unless something has changed over the last few years, that's what I understand our state DUI laws to be, and they're trying to clamp down harder by lowering the limit from .08 to .05. I don't drink much anymore and I encourage others to not, but that's just getting to be too much.

What seems crazy to me is , if you are changing out the radio in your TJ in your garage and have had a few to many drinks , you could be charged with DUI .
A county sheriff told me about this crazy enforcement possibility.

That's the way I understand it. If the keys are in the ignition, your eligible. For an average size male (~6' 175 lbs) two beers in an hour will have you around the legal limit of .08.

Even if true, which I doubt. How would they ever know you were drinking in the first place?

Garage door up so a LEO can observe you , key available in the vehicle and drinking . That would be all that's required .
It's pretty jacked up , but true . Most LEO's have more sense than to go down this road , however it would only take that one cop that;s a total dick.

Maybe there is a LEO on the forum who can expand on this.

Also, cops usually have eyeballs, so if they see a container....

I'm not allowed to have a beer in my shop? Beer is legal and I am allowed to have and drink it on my property, or why don't they just use this excuse all the time? It would make it pretty easy for them to get in/onto your property. Don't confuse having empty cans in the back of your truck while driving with empty cans in the shop garbage can.

There have been cases of someone walking out of a bar , going to the parking lot to their car and getting in the back seat to sleep the Buzz off . and get a DUI .
They weren't driving , were on private property , and trying to not drive drunk . The laws rewarded their effort with a DUI .

Yep, I have heard of this but, it’s not like the above example at all. I also do not agree with this, the person was not driving, it’s almost like some minority report policing.

Again, "probable cause". No one stated alcohol or the consumption of it was illegal. What was stated is that keys in your ignition while consuming that alcohol, even on private property, has the potential for issues.

Even if it doesn't hold up, if you're arrested, you will be spending time and money fighting it. Kind of in that same vein, I know a man who once got a BUI (Boating Under Influence) charge on a local public lake. We don't have a boating license in my state, or at least we didn't at that time, and the actual laws regarding the situation were basically public intoxication stuff, but he was still arrested, fingerprints/ mugshot, held until someone posted bail, then he spent a few thousand dollars fighting the charges. In the end I think his actual charges were public intoxication, court fees and a relatively small fine.

In the case I heard about the guy in the backseat of his car had his car keys in his pocket , not the ignition. The law said " he was in control of the car since he had the keys " Sounds like B.S. to me but the guy got a DUI .
