Again, "probable cause". No one stated alcohol or the consumption of it was illegal. What was stated is that keys in your ignition while consuming that alcohol, even on private property, has the potential for issues.

Even if it doesn't hold up, if you're arrested, you will be spending time and money fighting it. Kind of in that same vein, I know a man who once got a BUI (Boating Under Influence) charge on a local public lake. We don't have a boating license in my state, or at least we didn't at that time, and the actual laws regarding the situation were basically public intoxication stuff, but he was still arrested, fingerprints/ mugshot, held until someone posted bail, then he spent a few thousand dollars fighting the charges. In the end I think his actual charges were public intoxication, court fees and a relatively small fine.

The North Carolina example, your shop is not public vehicle area.
The Florida example, asleep in your car in the driveway, others had just pulled into the property.

We were talking about being in your shop having a drink.

I had a coworker many years ago (a funny SOB, but that's another story) who'd had a couple of DUIs.
One night, after drinking in the bar but not wanting to drive, he walked across the street to the city park (where his car was already parked.)
Wanting some tunes, he put the key in the ignition, turned it to accesory and set up a small tent.
And got another DUI.
The key in the ignition is what got him, is what the Deputy told him.

What seems crazy to me is , if you are changing out the radio in your TJ in your garage and have had a few to many drinks

Seems oddly specific, that's exactly what I was doing today (seriously, you wouldn't believe how long it took me to figure out I could eliminate the external equalizer completely by plugging the wires that go to the amp into the "pre-amp" plug on the head unit). Anyways, I definitely didn't have at least 3 beers trying to figure out why the hell the last guy used wire nuts.

No lie,

I was around 5 years old. Dad was working on the barn and sent me to the house to get him a beer.

About 10 minutes or so he went to the house asked mom where I was, she said he came and got you a beer About 5 minutes ago.

He found me behind the grain bin finishing off his beer.

Needless to say he never sent me after another one..........

Oh and I loved beer from that day forward.
 
There have been cases of someone walking out of a bar , going to the parking lot to their car and getting in the back seat to sleep the Buzz off . and get a DUI .
They weren't driving , were on private property , and trying to not drive drunk . The laws rewarded their effort with a DUI .

In Oklahoma they have a separate charge specifically for that, called Actual Physical Control or APC. I always thought it was BS because I only ever heard it used against people who were actually trying to do the right thing and NOT drive, but they still had their keys and were in a position where they COULD drive. Seems like some Minority Report stuff there, preemptively charging someone for something they could do but aren't....
