Please Learn From My Lack of Proper Insurance Coverage (Please Read)

Progressive received the estimate written by the body shop and has to transcribe it into their own estimate...Copy/paste. However, now the adjuster tells me that she cant write an estimate with 20 hours of frame repair into the estimate for Progressive's system.

I pushed back and asked why not and if there was nay legal justification or guidance on this issue and all I got was "we are still looking at and working on options."

Not sure what would play out if I just paid out of pocket for the repairs that the body shop quoted and then surprised Progressive with the news that it's been fixed...here's the bill.
Anyone?

I wouldn't do that. Without re-reading everything, I'm assuming the progressive estimate is much lower than the one you provided. Did their estimate include totaling? Part of the holdup could be having a claim that includes a totaled vehicle to now repairing it because the value of the Jeep is a lot higher than their estimate.

Don't just get it fixed and send Progressive the bill. They will still only pay what they think they reasonably owe and you will be stuck with the rest. Sorry if I missed earlier in the thread but is Progressive your insurance company or the other driver's company?
 
what people forget is insurance is literally gambling, and just like at the casino, the house always wins. I guess their army of statisticians has decided that if the vehicle gets used offroad, it's harder for them to guarantee that win.
I can see why a lot of people have that general assumption for the insurance industry, especially auto insurance since that is the form of insurance most people have dealt with regarding a claim. It can be a bit more complicated than that.

The U.S. auto insurance segment has historically been a losing game for the house with most carriers frequently experiencing combined ratio near or over 100%. (Combined ratio= losses + expenses ÷ earned premium) Meaning most auto carriers aren't turning a profit on the auto insurance line alone. They need that line to get to you purchase your home, life and other coverages. The auto insurance is kind of like a gateway to the rest of your insurance needs. Sometimes that pays off and sometimes it doesn't. In catastrophic weather exposed areas the auto and homeowners can take a hit at the same time.

Most policies cover damage while driving off road but it's best read your policy. You would be surprised how many agents don't know what the polic says. Good ones will. Most only exclude racing or racing events or some similar type of wording. Sure you may get dropped after a claim filed for wheeling off road but unless that policy specifically excludes driving off road then it should be covered. For most on here a flop from wheeling would likely be covered. What the actuaries don't account for in their pricing model is every Tom, Dick and Harry out in the woods denting their jeep up every weekend then submitting that for a claim. There is an inherent higher risk in driving off road which is why most of us like it.

The auto claims process sucks. Company trys to pay the least and you want the most. Progressive is one of worst IMO when it comes to dealing with claims. State Farm was easy for me in the past as well as Erie.
 
Back in the 90’s when I was a teen I had a 69 Chevy truck that I would drag race. One morning I go out to and my truck is gone. A week later it was found but completely stripped sitting on cinder blocks. It was totaled. My insurance company at the time ( State Farm) offered me….. I can’t remember but not even close to what it was worth. They told me to prove to them it was worth what I was asking for. The next couple weeks I cut out, or photocopied every add I could find for a truck that looked even remotely like mine that the seller was asking more for that I thought was a fair price for mine. It worked, I got a lot more than I was asking for from the insurance company.

my state farm agent got back with me and unfortunately the way I use my LJ doesn't allow it to qualify as a classic/antique, which I guess is reserved for summer Sunday drives and parades and stuff.

She assured me that my receipts would be sufficient, even when I told her I had over $17k in receipts and asked specifically whether that would present an issue.

Unfortunately that won't cover my HP30 axle or wheels which were craigslist buys, nor will it reimburse me for all the hours spent installing these parts (the only labor in that number is from the regear). But hopefully if something did ever happen, I won't be at a point where wheels and an old cherokee axle housing would make or break being able to replace it.

The used parts thing is what bothers me a little. If I insure, and something happens, I want to be whole. If I buy something used, put time and effort (and money) into rehabing it so that it is like new, then I should get coverage of said item...I know...hard to prove, but dang it...There isn't anything wrong with my control ams. I painted them, had the ends re-plated, and put all new "guts" in them. They are literally, "like new." But I got them used and because I don't have a receipt, I'm out the cost of new arms if something were to happen.

Might as well not carry insurance!

After pressing them and pushing back, Progressive worked on options, and offered me a check for their full valuation number and to keep the Jeep no questions asked, no title work, and I get it fixed where I want. (progressive’s value was $8,400/totaled)

I do have to sign a liablity release form stating I’m taking the check and wont hold Progressive or their driver liable for anything further.

Happy, they originally said it was worth $8,400, wanted to total it, and buy it from me. I got them to agree to pay me the $8,400 and I’m keeping the Jeep.

Not too long ago i had a company pay me for the damages. But before they wrote the check, they sent me a liability waver that was full of broad language and provisions that gave them full free reign to do as they wish if they felt that their reputation was damaged in any away.

We were cool and had a respectful negotiations until the moment they sent me that shit. I took a sharpie and redacted about 60% of the garbage i was not going to sign, and i told them straight up that their legal team will either edit it, or they can go fuck themself and see how far i am willing to take it.
Wow that still fires me up in rage just thinking about it.
 
I called them, and they told me there is no such thing as guaranteed price insurance for a non-classic car in Washington, and if i wanted to cover the Jeep that way it could "Never" go off road or daily drive.

He is going to quote me for coverage that would cover for off road damage like you said above (value + parts), but to do so I need to move all my vehicles, or at least one other vehicle to their insurance as well since they don't offer the off road piece as stand alone insurance, more like a rider on top of other more standard insurance, and the Jeep could not be the 'primary' vehicle.

He's working up a quote and we'll see how that Compares to what we have with State Farm.

But value for the jeep plus parts coverage. And no limit on my parts coverage. It’s the best I’m gonna get with peace of mind.

But yeah makes sense that you need to transfer all your vehicles. Good luck.

Yes, their language is pretty cut and dry, only wanting to be released from liability from here and in the future .
 
Realized that I never updated this thread with the damage to the Jeep.

The night of the accident:
He was attempting to turn left, crossing my lane. What was odd is that he waited until I was practially right in front of him before turning into my lane, claiming after the accident that he never saw me.

There was def some object fixation on my part as the events unfolded, mainly surprised by his vehicle crossing into my lane.
