If the hinge is hitting the taillight, then you need new hinges. You probably don't need heavy duty ones for a 31" tire, but it can't hurt.
The third brake light can be raised with spacers (or washers) and longer bolts. Or just take it off for now till you sort out the hinge issue.
And yes, you do want your snubbers up against the tire. Did the taillight problem happen after you drove around with the tire turned around?

I would have the same problem, but po put those ugly light guards on the tail lights. So now the door will touch the guard instead. Just open the door carefully and let it rest against the guard. Even in gusty wind it is enough to prevent any damage.
Unbolt the 3rd brake light from above the tire carrier and get longer bolts. Use som short lengths of pipe to keep the light above the tire.

Has anyone tried to "jury rig" this 'RUGGED-RIDGE-TAILGATE-ASSIST" item to a (2005) TJ ? I am thinking about giving it a try (to hold the tailgate open on a hill) . I saw a YouTuber about 14 years ago use something like this for YJ and TJ. The only difference was his interior mounting was lower - about mid way on the interior and the strut was angled upward to the Tailgate's upper center. I feel that he used a SUV (station wagons) tailgate strut. Any one out there with some ideas? All and any would be helpful, Thanks ! !

I put Tail Light Guards on my TJ. It solved the problem. Of course they were always there, because I brought it that way. I didn't realize how helpful and functional they would turn out to be. My rear door rests against it when it is open. I've had no damage in over 25 years.

I added this to stop the gate from closing when it's loaded up. Does nothing to limit how far it opens but I have the older hinges that seem to have internal stops.

Available on Quadratec but I went direct to the manufacturer, American Outlaw Jeep Parts. Prefer dealing direct and it was a few dollars cheaper.

I looked at a bunch of standard door stoppers on the web. Most looked like they would collapse with the weight of the tailgate, spare, tire carrier and loaded cargo basket. I've been using this for a few months, mostly while camping, and it is performing flawlessly. If I were to doit again, I think I would mount it to the bottom hinge.

Be careful when closing the tailgate. More than a few times I have forgotten that the Gate Keeper was open and proceeded to try to close the tailgate. No damage done but...
